Section 01

1.0Overview

This mobile application (“App”) is operated by Aliwala. Throughout these terms, “we”, “us”, and “our” refer to Aliwala. By downloading, installing, or using the Aliwala app, you (“user” or “you”) agree to be bound by these Terms of Service (“Terms”).

Important: These Terms constitute a legally binding agreement between you and Aliwala. If you do not agree to these Terms, do not download, install, or use the App.

2.0Section 1: App License and Usage

1.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your mobile device for your business and commercial purposes, including but not limited to bulk ordering, inventory management, and business-to-business transactions.

1.2 Business Account Requirements

  • You must be at least 18 years old or the legal age of majority in your jurisdiction
  • You must have the legal authority to bind your business/organization to these Terms
  • You must provide valid business registration details and tax information
  • Your business must be legally registered and authorized to operate in your jurisdiction

1.3 Device Requirements

  • Compatible Android device running Android 7.0 (API level 24) or higher
  • Stable internet connection for full functionality
  • Sufficient storage space as specified in the App listing
Section 05

1.4 Business Account Registration

  • You must provide accurate business information including company name, registration number, and tax identification
  • You are responsible for maintaining the confidentiality of your business account credentials
  • You must notify us immediately of any unauthorized use of your business account
  • You may authorize multiple users within your organization to access your business account
  • You are responsible for all activities conducted under your business account by authorized users

6.0Section 2: Prohibited Activities

You may not use the App to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Distribute malware, viruses, or harmful code
  • Engage in fraudulent activities or impersonation
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the App or its systems
  • Use automated scripts or bots without prior written authorization
  • Interfere with the App's functionality or security features
  • Post false, misleading, or defamatory content
  • Engage in spam or unsolicited commercial communications to end consumers
  • Use the App for any illegal business activities
  • Violate any trade restrictions or sanctions
  • Resell access to the App without our written permission

7.0Section 3: App Content and Intellectual Property

3.1 Our Content

All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, and software, are owned by Aliwala and protected by copyright, trademark, and other intellectual property laws.

3.2 User-Generated Content

  • You retain ownership of content you submit through the App
  • By submitting content, you grant us a worldwide, royalty-free license to use, modify, and distribute such content for App operation
  • You represent that you have the right to submit such content
  • We may remove content that violates these Terms or applicable laws

3.3 Prohibited Content

  • Violates applicable laws or regulations
  • Infringes intellectual property rights
  • Contains hate speech, discriminatory language, or promotes violence
  • Is sexually explicit or inappropriate
  • Contains personal information of others without consent
  • Promotes illegal activities or substances

10.0Section 4: Privacy and Data Protection

4.1 Data Collection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

4.2 Permissions

The App may request access to certain features or data on your device. You can manage these permissions through your device settings.

4.3 Business Data and Confidentiality

  • We understand that your business data is confidential and commercially sensitive
  • We will not share your business information with competitors
  • Aggregated, anonymized data may be used for analytics and service improvement
  • You retain ownership of all business data you upload to the App
Section 13

13.0Section 5: Orders, Payments, and Business Transactions

5.1 Order Processing

  • All orders placed through the App are subject to acceptance by Aliwala
  • We reserve the right to reject orders that appear fraudulent or violate these Terms
  • Bulk orders may be subject to additional verification requirements
  • Order confirmation does not guarantee product availability

5.2 Pricing and Payment Terms

  • All prices are displayed in Indian Rupees (INR) unless otherwise specified
  • Prices are subject to change without notice
  • Payment terms for business accounts may include credit arrangements subject to separate agreements
  • Late payment fees may apply as specified in your business account terms
Section 15

5.3 Payment Processing

  • We use secure payment gateways to process transactions
  • Payment information is encrypted and stored securely
  • We do not store credit card information
  • We are not liable for any unauthorized access to your payment information
Section 16

5.4 Business Billing

  • Business accounts may have access to credit terms, bulk discounts, and custom pricing
  • Invoice payments are subject to the payment terms agreed upon during account setup
  • All business transactions are subject to applicable taxes and duties
  • You are responsible for all taxes related to your purchases
Section 17

5.5 Refunds and Cancellations

  • Refund Processing: Refunds will be processed within 7 business days of receiving the returned item(s), or as specified in your Business Account Agreement.
  • Cancellation Policy: Order cancellations may be subject to a 10% restocking fee, unless otherwise stated in your Business Account terms.
  • Refund Request Window: Refund requests must be submitted within 30 calendar days of purchase or as defined in your Business Account Agreement.
  • Refund Method: Approved refunds will be issued to the original payment method, unless otherwise agreed in your Business Account.
  • Non-Refundable Items: Items such as clearance products, perishable goods, software licenses, and digital downloads are non-refundable.
  • Custom Orders: Custom-made or personalized items are non-refundable and non-cancellable once production begins, unless received damaged or defective.
  • Shipping Costs on Returns: Return shipping costs are the customer's responsibility and non-refundable, unless due to an error or defective item.
  • Damaged or Defective Goods: You must report any damaged or defective items within 7 business days of delivery. We will provide a replacement, repair, or full refund, including return shipping, upon verification.

5.6 Order Modifications and Cancellations

  • Order modifications may be possible before processing begins
  • Cancellation policies vary based on order size and processing status
  • Custom or bulk orders may have different cancellation terms

19.0Section 6: Service Level and Business Support

6.1 Service Availability

  • We strive to maintain 99.5% uptime for business-critical functions
  • Planned maintenance will be scheduled during off-peak hours when possible
  • We provide 24/7 technical support for business account holders
  • Emergency support is available for critical business disruptions

6.2 Business Account Features

  • Priority customer support and dedicated account management
  • Access to bulk ordering tools and custom pricing
  • Advanced reporting and analytics features
  • Integration capabilities with business systems (subject to separate agreements)
Section 21

6.3 Updates and Compatibility

  • We may release updates to improve functionality, security, or add business features
  • Critical security updates may be mandatory for continued use
  • We will provide advance notice of major changes that may affect business operations
  • Legacy version support may be available for enterprise clients
  • We reserve the right to discontinue support for older versions

22.0Section 7: Third-Party Services

7.1 Google Play Services

The App integrates with Google Play Services and is subject to additional terms and policies from Google.

The App may contain links to third-party websites or services. We are not responsible for the content or privacy practices of these third parties.

7.3 Analytics and Advertising

We may use third-party analytics and advertising services. These services have their own privacy policies and terms of use.

25.0Section 8: Disclaimers and Limitation of Liability

8.1 Disclaimers

  • The App is provided "as is" and "as available" without warranties of any kind
  • We do not warrant that the App will be error-free or uninterrupted
  • We disclaim all implied warranties, including merchantability and fitness for a particular purpose

8.2 Limitation of Liability

To the maximum extent permitted by law, Aliwala's total liability for any claims arising from your use of the App shall not exceed:

  • For free business accounts: INR 10,000
  • For paid business accounts: The amount paid by you in the 12 months preceding the claim
  • For enterprise accounts: As specified in your separate enterprise agreement

We shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunities due to App unavailability
  • Damages resulting from third-party integrations or services
  • Business losses due to order processing delays or errors

8.3 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, or network failures.

28.0Section 9: Indemnification

You agree to indemnify and hold harmless Aliwala, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations

29.0Section 10: Termination

10.1 Termination by You

You may terminate your access to the App at any time by ceasing to use the App and uninstalling it from your device.

Section 30

10.2 Termination by Us (Aliwala)

We may terminate or suspend your access to the App immediately if you:

  • Violate any applicable laws or regulations
  • Engage in fraudulent or abusive activities
  • Breach any provision of these Terms
  • Fail to comply with applicable laws
Section 31

10.3 Effect of Termination

Upon termination:

  • Your license to use the App terminates immediately
  • You must uninstall the App from your device
  • Certain provisions of these Terms will survive termination

32.0Section 11: Governing Law and Disputes

11.1 Governing Law

These Terms are governed by the laws of Rajasthan, India, without regard to conflict of law principles.

Section 33

11.2 Jurisdiction

Any disputes arising from these Terms or the App will be subject to the exclusive jurisdiction of the courts in Pali and Jaipur, Rajasthan, India.

11.3 Arbitration and Dispute Resolution

Before filing any formal legal action, you agree to first contact us at info@aliwala.in or through our support channels to attempt to resolve the dispute informally.

If the dispute cannot be resolved informally, you agree to submit to arbitration in accordance with the rules of the Arbitration Institute of the Chamber of Commerce (AIACC) and the laws of Rajasthan, India.

12.1 Developer Program Policies

This App complies with Google Play Developer Program Policies, and users must also comply with applicable policies when using the App.

All content within the App adheres to Google Play's content policies regarding:

  • Restricted content
  • Intellectual property
  • Privacy and security
  • Spam and minimum functionality requirements

Users can report policy violations or inappropriate content through the App's reporting feature or by contacting us directly.

13.1 Accessibility

We strive to make the App accessible to users with disabilities in accordance with applicable accessibility standards.

The App primarily supports English. Additional language support may be added in future updates.

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Aliwala regarding the App and supersede all prior or contemporaneous communications and proposals, whether oral or written.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

Section 42

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce such provision in the future.

14.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Updates to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes through:

  • Updates to this document with revised effective date
  • Email notifications (if applicable)
  • In-app notifications (if applicable)
  • Push notifications or in-app messages (if applicable)

Your continued use of the App after any changes constitutes acceptance of the updated Terms.
